1. Who we are

Breakout Creative Agency ("Breakout", "we", "us", "our") is a business registered in the Commonwealth of The Bahamas under registration number 20090633, with its principal place of business at #13 Benson Crescent, New Providence, The Bahamas.

We are a content marketing and video production agency. We film, edit and distribute video content, and we manage paid social advertising, for business clients.

For the purposes of Bahamian data protection legislation, Breakout Creative Agency is the data controller in respect of the personal data described in this Policy.

2. What this Policy covers

This Policy explains how we collect, use, store, share and protect personal data when you:

Section 8 deals specifically with filmed and photographed individuals. If you appeared in something we shot, that is the section that concerns you.

3. The personal data we collect

3.3 Audiovisual data

Video footage, still photography, audio recordings and any personal data captured within them, including images of faces, voices, vehicle registrations, signage, and anything else recorded at a shoot. See section 8.

3.4 What we do not collect

We do not knowingly collect sensitive personal data (such as data revealing health, racial or ethnic origin, political opinions, religious beliefs, biometric or genetic data, or sexual orientation) unless it is unavoidably captured in footage you have commissioned, or you volunteer it. We do not process payment card numbers on our own systems; card payments, where accepted, are handled by our payment provider.

Where we rely on legitimate interests, we have considered whether those interests are overridden by your rights, and we will stop processing on that basis if you object and we cannot show compelling grounds to continue.

5. Direct marketing and your right to stop it

Bahamian data protection law gives you the right to require us, by written notice, to stop using your personal data for direct marketing. We will comply free of charge and within a reasonable period, and in practice we aim to action it within seven days.

You can opt out at any time by clicking unsubscribe in any marketing email, or by emailing info@breakoutcreativeagency.com with the word UNSUBSCRIBE.

Opting out of marketing does not stop service messages - invoices, delivery notifications, scheduling and similar communications necessary to perform a contract you have with us.

6. Who we share your personal data with

We do not sell your personal data. We share it only as set out below.

Subcontracted crew. We engage freelance camera operators, editors, sound recordists and assistants. Where they access personal data, they are bound by written confidentiality and data protection obligations.

7. Cookies and tracking

We use:

Where required, we ask for your consent before setting non-essential cookies. You can withdraw consent at any time by emailing us, and you can block or delete cookies in your browser settings - though parts of the site may stop working properly if you do.

We also send certain conversion events to Meta from our own server via the Conversions API. Where we do this, your email address and telephone number are irreversibly hashed before transmission. We do not send Meta your name, your message, or the content of your enquiry.

8. If you were filmed or photographed by us

This section applies to anyone appearing in content we produce - client staff, customers, event attendees, members of the public, and talent.

8.1 What we capture. Moving image, still image and audio recordings in which you may be identifiable.

8.2 Why. To produce the content our client has commissioned, and - where permitted under 8.4 - to demonstrate our work.

8.3 Releases. Where you appear as a featured subject, we or our client will ask you to sign a release. The release governs how that specific footage may be used. Where we film in a public or semi-public setting (for example, an event), we or the event organiser will display notices advising that filming is taking place.

8.4 Portfolio use. We may use produced work in our showreel, website, social media and pitch materials. Where an individual is prominently featured, we rely on the release signed for that shoot. If you appear in our work and want your image removed, email info@breakoutcreativeagency.com. We will remove it from material within our control and will tell you what we cannot control - for example, content already published on a client's own channels, or third-party reposts.

8.5 Children. We do not film an identifiable child as a featured subject without the written consent of a parent or legal guardian. Where a child appears incidentally, we will blur or remove them on request.

8.6 Raw footage. Unused footage is retained under section 9 and is not published.

9. How long we keep personal data

We keep data no longer than necessary. Where we no longer need it but cannot immediately delete it (for example, in backups), we isolate it and delete it on the next backup cycle.

10. Transfers outside The Bahamas

This section matters, and you should read it.

Bahamian data protection law restricts transferring personal data to countries that do not provide an adequate level of protection, and the Data Protection Commissioner may prohibit or place conditions on such transfers.

Several of our service providers are located outside The Bahamas, principally in the United States and the European Union. Where we transfer your personal data outside The Bahamas, we do so on the basis that:

We maintain technical and organisational measures appropriate to the risk, including:

No system is perfectly secure. If a breach occurs that is likely to affect your rights, we will notify the Data Protection Commissioner and, where required, you, in accordance with the timescales set out in the applicable legislation.

We may ask you to verify your identity. We do not charge for this, unless a request is manifestly unfounded or excessive.

If you are unhappy with how we have handled your personal data, please contact us first - most issues are resolved quickly.

14. Visitors from the EU and UK

We are established in The Bahamas and do not target the EU or UK market. Where the GDPR or UK GDPR applies to a particular engagement - for example, if we film in Europe or process the data of individuals in Europe on a client's behalf - we will agree appropriate terms with that client and comply with the additional obligations that apply.

15. Changes to this Policy

We may update this Policy. The "last updated" date at the top will change. Where changes are material, we will notify you by email or by a prominent notice on the site before they take effect.
